Negligence per se

Term · Law · MLC-T-LAW-003377

A legal doctrine establishing that an act is inherently negligent if it violates a statute or regulation designed to protect a specific class of people from a particular type of harm. When a defendant's conduct breaches such a law and causes injury, the plaintiff does not need to prove the defendant's lack of reasonable care. This doctrine shifts the focus from proving a duty of care and breach to demonstrating the statutory violation and causation of injury.
