Negligence

The failure to exercise the degree of care that a reasonably prudent person would exercise in similar circumstances, resulting in harm to another. This legal concept forms the basis for many personal injury lawsuits. To establish negligence, a plaintiff must prove duty, breach of duty, causation, and damages.
