Contributory negligence

Term · Law · MLC-T-LAW-001283

A defense in tort law asserting that the plaintiff's own failure to exercise reasonable care for their safety contributed to their injuries, thereby barring or reducing their recovery. In jurisdictions that follow a pure contributory negligence rule, any degree of plaintiff's fault completely prevents recovery. Many jurisdictions have replaced this with comparative negligence, which apportions fault.
