Partial defense

A legal argument or set of facts that, if proven, does not completely absolve a defendant of liability but reduces the degree of fault or the amount of damages owed. It mitigates the plaintiff's claim rather than defeating it entirely. Examples include comparative negligence in tort cases or diminished capacity in criminal law.
