Term · Insurance and risk management · MLC-T-INS-000962
A legal defense in tort law where a plaintiff's own negligence contributed to their injuries, thereby barring or reducing their ability to recover damages from the defendant. In jurisdictions that follow pure contributory negligence, any degree of plaintiff negligence prevents recovery. Most states have adopted comparative negligence, which apportions fault and damages accordingly.
