Comparative negligence

A legal principle used in accident claims to determine the degree of fault for each party involved, and to allocate damages accordingly. Under this rule, an injured party can still recover damages even if partially at fault, but their recovery is reduced by their percentage of negligence. Many states use either pure comparative negligence or modified comparative negligence rules.
