Last clear chance rule
Term · Insurance and risk management · MLC-T-INS-001959
A doctrine in tort law that allows a plaintiff to recover damages despite their own contributory negligence, if the defendant had the final opportunity to avoid the accident but failed to do so. This rule applies in jurisdictions that follow contributory negligence principles, mitigating the harshness of a complete bar to recovery. It shifts the focus to the party with the last opportunity to prevent the harm.
