Last injurious exposure
Term · Insurance and risk management · MLC-T-INS-001961
A legal rule used in workers' compensation cases to assign liability for occupational diseases that develop over a long period and involve multiple employers or insurers. Under this rule, the employer or insurer providing coverage at the time of the employee's most recent exposure to the harm-causing substance or condition is held fully responsible for the claim. This principle avoids the difficulty of apportioning liability among multiple parties over many years.
