Common law defenses
Term · Insurance and risk management · MLC-T-INS-000849
Legal arguments available to a defendant in a tort action that originated from judicial decisions rather than statutory enactments. These defenses, such as contributory negligence, assumption of risk, and the fellow servant rule, were historically used to limit an employer's liability for employee injuries. While some have been modified or replaced by statutes, their principles still influence modern liability law.
