Negligence

The failure to exercise the degree of care that a reasonably prudent person would have exercised under the same circumstances, resulting in harm to another party. To establish negligence, four elements must be proven: duty, breach of duty, causation, and damages. This concept forms the basis for many liability claims in insurance.
