Per stirpes

Term · Law · MLC-T-LAW-003703

A method for distributing a decedent's estate in which each branch of the family is treated equally. If a named beneficiary has predeceased the person whose estate is being divided, that beneficiary's share is passed down in equal portions to their own descendants. This method contrasts with a per capita distribution, where all surviving descendants at the same generational level receive an equal share regardless of their family branch.
