Parentelic system

Term · Law · MLC-T-LAW-003621

A method for determining the order of inheritance for an intestate estate, where property passes to the decedent's descendants before ascending to parents or collateral relatives. Under this system, the estate is distributed down each line of descent, or parentela, starting with the decedent's children and their issue. If no descendants exist, the estate moves to the next parentela, which consists of the decedent's parents and their descendants, such as siblings, nieces, and nephews.
