Presumed abuse

A legal inference that abuse has occurred based on certain facts or relationships, shifting the burden of proof to the accused party to demonstrate otherwise. This concept arises in situations where a power imbalance exists, such as between a fiduciary and a beneficiary. For example, transactions between an attorney and client are sometimes subject to a presumption of undue influence.
