Presumed maximum value

An SSI rule that caps the in-kind support and maintenance, such as free shelter provided by someone else, that Social Security counts as a recipient's unearned income. Social Security counts the lesser of the actual value received or the cap, which equals one third of the federal benefit rate plus the $20 general income exclusion. In 2023 the cap for an individual was $324.67 a month, and the recipient may rebut the presumption with evidence of a lower value.
