Presumption

A legal inference that a fact exists, drawn from the existence of other known or proven facts. It operates to shift the burden of proof or the burden of producing evidence to the opposing party. Rebuttable presumptions, such as the presumption of innocence, can be overcome by evidence to the contrary.
