Burden of persuasion

The obligation of a party to convince the trier of fact (judge or jury) of the truth of a particular issue. This burden remains with the party throughout the trial and requires them to establish their claim or defense by a specified standard of proof, such as a preponderance of the evidence or beyond a reasonable doubt. It is distinct from the burden of production.
