A constitutional limitation on the government's power of eminent domain, requiring that private property taken for public purposes must be for the benefit of the community as a whole. This concept has been broadly interpreted to include not only direct public access but also economic development that serves a public purpose. The Fifth Amendment to the U.S. Constitution mandates just compensation for such takings.
