Open Burning

1. Uncontrolled fires in an open dump.

2. The combustion of any material without the following characteristics: (1) Control of combustion air to maintain adequate temperature for efficient combustion, (2) Containment of the combustion-reaction in an enclosed device to provide sufficient residence time and mixing for complete combustion, and (3) Control of emission of the gaseous combustion products.

3. Burning of solid wastes in the open, such as in an open dump. [40 CFR 240.101 (CFR 2013)]Burning of a material that results in the products of combustion being emitted directly into the atmosphere without passing through a stack. Open burning includes burning in burn barrels.

4. The combustion of solid waste without:(1) Control of combustion air to maintain adequate temperature for efficient combustion,(2) Containment of the combustion reaction in an enclosed device to provide sufficient residence time and mixing for complete combustion, and(3) Control of the emission of the combustion products.

5. Combustion of any material without the following characteristics:(1) Control of combustion air to maintain adequate temperature for efficient combustion,(2) Containment of the combustion-reaction in an enclosed device to provide sufficient residence time and mixing for complete combustion, and(3) Control of emission of the gaseous combustion products.(See also “incineration” and “thermal treatment”.)

6. Combustion of any PCB regulated for disposal, in a manner not approved or otherwise allowed under subpart D of this part, and without any of the following:(1) Control of combustion air to maintain adequate temperature for efficient combustion.(2) Containment of the combustion reaction in an enclosed device to provide sufficient residence time and mixing for complete combustion.(3) Control of emission of the gaseous combustion products.
