Mixed-motive evidentiary standard
Term · Insurance and risk management · MLC-T-INS-002208
A legal standard in discrimination cases where an employee demonstrates that an unlawful reason, such as discrimination, was one motivating factor for an adverse employment action, even if other lawful reasons also existed. Under this standard, if the employer proves it would have taken the same action regardless of the discriminatory motive, the employee may still be entitled to declaratory relief and attorney's fees, but not necessarily reinstatement or damages.
