Negligent referral

The act of recommending a professional or service provider whom the referrer knows or should know is incompetent or unsuitable, resulting in harm to the person receiving the referral. This can occur when a healthcare provider refers a patient to a specialist without proper vetting or when an employer recommends a former employee known to be unfit. Liability for negligent referral depends on the duty of care owed by the referrer.
