Continuous treatment rule
Term · Insurance and risk management · MLC-T-INS-000938
A legal doctrine that postpones the start of the statute of limitations for medical malpractice claims until a patient's course of treatment for a particular condition with a specific healthcare provider has ended. This rule acknowledges that a patient may not discover an injury until after the initial negligent act. It aims to prevent patients from being barred from suing before they reasonably could have known about the malpractice.
