Presumptive indemnification provision

Term · Insurance and risk management · MLC-T-INS-002655

A clause in a directors and officers (D&O) liability insurance policy that assumes the company has indemnified its directors and officers to the fullest extent permitted by law. This assumption allows the insurer to allocate a larger portion of a loss to the company's side of the policy, reducing the amount paid under the D&O coverage for individual directors and officers. It impacts how defense costs and settlements are shared.
