Primary and noncontributory

A contractual provision in an insurance policy, typically an additional insured endorsement, stating that the named insured's policy will respond first to a loss (primary) and that other applicable insurance policies will not be called upon to contribute to the loss (noncontributory). This clause clarifies the order of payment among multiple policies. It is frequently used in construction contracts to protect upstream parties.
