Significant deviation

Term · Insurance and risk management · MLC-T-INS-003085

A legal standard in workers' compensation used to determine if an employee's actions at the time of an injury were so far removed from their job duties that the injury is not compensable. This occurs when an employee engages in a personal errand or activity that is a major departure from the course and scope of employment. A minor departure, such as a brief personal phone call, is not a significant deviation and does not typically bar a claim.
