The nature of an employee's job duties, which establishes their eligibility for benefits under a specific workers' compensation law. This legal test considers whether the work itself falls within the scope of the governing statute, independent of where the injury occurred. For example, under the federal Longshore and Harbor Workers' Compensation Act, an employee must have the status of a maritime worker, such as a longshoreman or ship repairer, to be covered.
