ABC test

A legal standard used in some jurisdictions to determine whether a worker is an independent contractor or an employee for purposes of wage and hour laws, unemployment insurance, and workers' compensation. To be classified as an independent contractor, the worker must satisfy all three conditions: (A) free from control and direction, (B) performs work outside the usual course of the business, and (C) customarily engaged in an independently established trade or business. Failure to meet any part of the test typically results in employee classification.
