ABC test

Term · Law · MLC-T-LAW-000266

A legal standard used in some jurisdictions to determine whether a worker is an independent contractor or an employee. To be classified as an independent contractor, the worker must satisfy all three criteria: (A) free from control and direction, (B) performs work outside the usual course of the business, and (C) customarily engaged in an independently established trade or business. Failure to meet any part of the test results in employee classification, which carries different labor law obligations.
