Basis of the bargain test

A legal standard used in contract law, particularly concerning warranties, to determine whether a seller's affirmation of fact or promise became part of the agreement between the parties. If a buyer relies on such a statement when deciding to purchase, it forms part of the basis of the bargain. This test is codified in the Uniform Commercial Code.
