Unconscionable

Describing a contract or clause that is so grossly unfair, one-sided, and oppressive that a court will refuse to enforce it. The term applies when one party has vastly superior bargaining power and uses it to impose terms that a reasonable person would not accept. Courts examine both the process of forming the contract (procedural unconscionability) and the fairness of its terms (substantive unconscionability) when making a determination.
