Abuse of process

The malicious and improper use of a regularly issued court process, such as a subpoena or arrest warrant, for a purpose other than that for which it was intended. This tort requires proof of an ulterior motive and a willful act in the use of the process not proper in the regular conduct of the proceeding. It differs from malicious prosecution, which concerns the initiation of a baseless lawsuit.
