Malicious prosecution

A tort claim brought by a person who has been subjected to a baseless and maliciously initiated criminal or civil legal proceeding. To succeed, the plaintiff must prove that the defendant initiated the prior proceeding without probable cause and with malice, and that the proceeding terminated in the plaintiff's favor. This tort protects individuals from vexatious litigation.
