Vindictive prosecution

A prosecution initiated by the government in retaliation for a defendant's exercise of a legal right. This occurs when a prosecutor increases the severity of charges or brings new charges solely to punish a defendant for asserting their constitutional or statutory rights. Courts may dismiss charges if vindictive prosecution is proven.
