To terminate a legal action or a charge against a defendant without a trial or a finding of guilt or innocence. A dismissal occurs by order of the court, either on its own motion or upon a motion by the prosecution or defense. A case is dismissed with prejudice when the prosecutor is barred from refiling the same charges, whereas a dismissal without prejudice permits the charges to be brought again at a later time.
