Charges dismissed

Term · Law · MLC-T-LAW-000939

A court order or decision that terminates a criminal case against a defendant without a conviction. A dismissal can occur for many reasons, including insufficient evidence, a violation of the defendant's constitutional rights, or a prosecutor's motion to drop the case. A case dismissed "with prejudice" cannot be refiled, whereas a dismissal "without prejudice" permits the prosecutor to bring the same charges again later.
