With prejudice

Term · Law · MLC-T-LAW-005474

A final determination of a legal action on its merits, preventing the same claim from being filed again by the same parties. When a court dismisses a case with prejudice, the plaintiff is permanently barred from re-litigating the same issue. This contrasts with a dismissal "without prejudice," which permits the plaintiff to correct any procedural errors and refile the lawsuit.
