Plea in abatement

Term · Law · MLC-T-LAW-003770

A procedural defense raised by a defendant that challenges the court's jurisdiction or the plaintiff's right to bring the action, without addressing the merits of the case itself. This plea asserts a defect in the lawsuit that requires its temporary suspension or dismissal, such as a misnomer of a party or a pending prior action between the same parties. If successful, it typically results in the abatement of the action rather than a final judgment on the claims.
