Abatement ab initio

The legal principle where a criminal conviction is nullified from the very beginning if the defendant dies while an appeal is pending. The death of the appellant prevents the appellate court from reviewing the merits of the case. This renders the conviction as if it never occurred, erasing the legal record of guilt.
