Disjunctive allegations

Term · Law · MLC-T-LAW-001658

Allegations in a pleading or charging document that state alternative acts, means, or facts joined by the word 'or'. In a criminal indictment they were traditionally attacked as uncertain, because the charge fails to tell the defendant which act is alleged, though some modern state codes now accept them for offenses with several alternative modes of commission. The civil counterpart is Federal Rule of Civil Procedure 8(d)(2), which authorizes pleading in the alternative.
