Confession and avoidance

A pleading strategy in civil litigation where a party admits the truth of the opposing party's allegations but then presents new facts or arguments that legally justify or excuse the admitted conduct. This defense does not deny the facts but seeks to avoid their legal consequences. Examples include claims of self-defense or statute of limitations.
