Selective prosecution

The unconstitutional practice by which prosecutors single out defendants for prosecution based on impermissible grounds, such as race, religion, or other arbitrary classifications. This violates the Equal Protection Clause of the Fourteenth Amendment. To prove selective prosecution, a defendant must show that others similarly situated were not prosecuted and that the prosecution was based on discriminatory intent.
