Malice aforethought

The mental state that distinguishes murder from manslaughter, satisfied by an intent to kill, an intent to inflict grievous bodily harm, extreme recklessness showing indifference to human life, or a death caused during certain dangerous felonies. Despite the word aforethought, it does not require planning beforehand, and it does not imply ill-will toward the victim. Premeditation is a separate element of first-degree murder in many states.
