First-degree murder

The most serious category of homicide, characterized by a willful, deliberate, and premeditated killing. This charge requires the prosecution to prove beyond a reasonable doubt that the defendant acted with malice aforethought and planned the killing before committing it. In many jurisdictions, a killing that occurs during the commission of another dangerous felony, such as robbery or arson, also constitutes first-degree murder under the felony murder rule.
