Adhesion contract (contract of adhesion)

Term · Law · MLC-T-LAW-000361

A standardized contract drafted by one party and presented to another on a "take it or leave it" basis, allowing little or no opportunity for negotiation. These contracts are common in consumer transactions, such as insurance policies, rental agreements, and terms of service for online platforms. Courts may scrutinize adhesion contracts for unconscionability or unfair terms, particularly if there is a gross disparity in bargaining power between the parties.
