Unconscionability

A doctrine in contract law that permits a court to refuse to enforce a contract or a clause within a contract if it is so unfair or oppressive to one party that it shocks the conscience of the court. This typically arises from an extreme imbalance in bargaining power. Courts evaluate both procedural and substantive elements of unfairness.
