Term · Law · MLC-T-LAW-001663
The legal standard for testamentary capacity, meaning a testator must possess sufficient mental ability to understand the nature and extent of their property, the natural objects of their bounty, and the effect of their will. This does not require perfect mental health, but rather a rational understanding at the time the will is executed. It is a key element in determining the validity of a will.
