Doctrine of alternative liability
Term · Law · MLC-T-LAW-001699
A legal principle allowing a plaintiff to shift the burden of proof to multiple defendants when it is clear that one of them caused the injury, but it is impossible to determine which specific defendant was responsible. Each defendant must then prove that they did not cause the harm. This doctrine is typically applied in cases where all defendants acted negligently and their actions created a similar risk of harm.
