Rescue doctrine
Term · Law · MLC-T-LAW-004264
A legal principle that allows a rescuer to recover damages from the party whose negligence created the danger, even if the rescuer voluntarily encountered the risk. This doctrine applies when the rescuer's intervention was not reckless and was a reasonable response to a perceived peril. It serves as an exception to the general rule that one who voluntarily assumes a risk cannot recover for injuries sustained.
