Dodd-Frank: Title XVI - Section 1256 Contracts

The title of the Dodd-Frank Act with a single tax provision, Section 1601, which provides that interest rate, currency, commodity, equity and credit default swaps and similar agreements are not section 1256 contracts. Those swaps therefore stay outside the Internal Revenue Code rules that mark regulated futures to market at year end. Section 1256 contracts that are covered receive 60 percent long-term and 40 percent short-term capital gain treatment.
