Driving while Black

Term · Law · MLC-T-LAW-001759

A form of racial profiling where law enforcement officers stop, question, and search Black motorists at a disproportionately high rate compared to drivers of other races, often based on racial stereotypes rather than evidence of a traffic violation. This practice involves pretextual stops, where a minor infraction is used as a reason to investigate a driver for unrelated, more serious crimes. Statistical evidence from traffic stop data is frequently used in litigation and policy debates to demonstrate the existence and extent of this discriminatory pattern in policing.
