Earwitness

Term · Law · MLC-T-LAW-001795

A person who testifies in a legal proceeding about something they heard rather than something they saw. The testimony provided by an earwitness is a form of direct evidence, although its reliability is subject to scrutiny regarding factors like the clarity of the sound, background noise, and the witness's ability to identify voices or sounds. Unlike an eyewitness who reports visual observations, an earwitness's account is based solely on auditory perception.
